Attorney Terms

These Attorney Terms apply to attorneys who receive and accept requests through Lawber. They add to the Terms of Service; where the two differ for attorneys, these Attorney Terms apply. Lawber is operated by StopScam LLC, 254 Chapman RD STE 208, Newark, Delaware, 19702, US (“we”, “us”).

1. Who can accept requests

  • You must be an attorney licensed and in good standing in the state where you provide the service, and allowed to provide the type of service requested.
  • To accept requests you submit your state of license, bar number and license expiry, a photo of your license, a government ID and a selfie with the ID. Lawber staff review them; an AI tool may help search public registries, but a person decides. We may ask for more documents, check your license again periodically and remove access if it can’t be confirmed.
  • Your license must remain valid through the date of each request you accept. The app won’t let you accept a request that starts after your license expires.
  • Tell us right away through Support if your license status changes, including suspension, discipline or restrictions.
  • To receive payouts you connect a Stripe account (Stripe Connect) and keep it in good standing.

2. Your independence and professional duties

  • You are an independent professional, not an employee, partner or agent of Lawber. Lawber does not direct or control your legal work or judgment.
  • You are responsible for complying with the rules of professional conduct of your jurisdiction, including conflict checks, confidentiality, competence and communication with the client, and any rules that apply to the way you receive requests and fees.
  • The scope of your representation is agreed between you and the client. If your rules require a written engagement or a limited-scope agreement, you arrange it with the client.
  • You are responsible for any insurance, registrations and taxes that apply to your practice.

3. Receiving and accepting requests

  • You see requests within your work radius and are notified about new requests in your state. Urgent requests are offered to you only if you turn on “Accept urgent requests” and confirm that you can react quickly.
  • Before accepting, check that you can arrive in time and that you can do the task. If the task requires the client to be present, say so when accepting: the client is asked to confirm, and the request is assigned to you only after the confirmation.
  • Accepting a request is a commitment to arrive in the arrival window shown in the app.
  • To keep service reliable, the app limits how many requests you can hold: a number per 7 days that grows with your completed requests, at most 3 requests within 12 hours of each other, and no overlapping requests (a service is counted as 2 hours plus travel time).

4. Before the service day

  • Before the service day, the client sees your photo, state of license, languages and number of completed Lawber requests, but not your name. Messages and calls open on the service day (for an urgent request — right away).
  • If you can’t take a request after accepting it, withdraw in the app as early as possible:

  • If no replacement accepts by the deadline, the request closes and the client’s hold is released.

5. The service day

  • Mark “Arrived” only when you are actually at the place. The arrival window opens 60 minutes before a scheduled start and closes 30 minutes after it; for an urgent request you must arrive within 60 minutes of accepting (or by the time shown). If you don’t mark arrival by the deadline, the request is canceled as “attorney didn’t come” and nothing is paid.
  • Marking arrival when you are not there is a serious breach. If Support confirms a false arrival, nothing is paid for it and your account may be suspended.
  • When the service is over, mark “Completed” and choose what happened: service provided (and what you did), hearing postponed or canceled, or client didn’t show. If a pre-consultation was ordered, say whether it took place; if not, its price is not charged.
  • “Client didn’t show” is available only when the client’s presence was agreed as required, after waiting at least 30 minutes and trying to contact the client in the app.
  • If after arriving you can’t continue (for example, because of illness or an emergency), report it in the app with the reason and what has been done. Tell the court or other participants what your professional rules require. Lawber Support then decides on a replacement and on payment for the part you completed.
  • Sharing your location with the client on the service day is optional and can be turned off.

6. Payment and payouts

  • The client pays through Lawber. The client’s price consists of your fee (callout, urgent surcharge, pre-consultation if held, and any Boost the client added) and Lawber’s service fee, which the client pays for the platform. Your payout is the client’s price minus the service fee. Coupon discounts are paid by Lawber and don’t reduce your payout.
  • If the hearing is postponed or the client doesn’t show after you arrived, you are paid in full (except a pre-consultation that didn’t take place).
  • The client’s card is charged when you mark “Completed”. If you marked “Arrived” but not “Completed”, the held amount is charged shortly before the hold expires; this payment is released to you only after Lawber Support reviews it. A late report you send in the app is considered in that review.
  • Payouts are made to your Stripe account no earlier than 72 hours after the charge. If there was no dispute and you enabled automatic payouts, the payout is automatic; otherwise it is made after review.
  • If the client opens a dispute, the payout waits for Support’s decision. A refund to the client reduces your payout by the refunded amount. An amount you owe after a dispute decision may be deducted from your next payout.
  • If another attorney replaces you after you arrived, Lawber Support decides how much of the payment is due for the part you completed; that amount is paid by Lawber.
  • Arrange and receive payment for requests you got through Lawber only through Lawber.

7. Reliability

  • Your account status can be normal, limited (a lower number of requests), paused (no new requests; you finish the ones you have) or suspended (no new requests; future requests are reassigned).
  • Late withdrawals are handled as shown in section 4. A confirmed no-show pauses your account for 14 days; a second one within 90 days leads to suspension. Two reliability complaints at the same time pause new requests until they are reviewed.
  • A suspension is lifted only by a person at Lawber after review. Quality complaints (for example, about communication) are reviewed individually.

8. Problems and disputes

  • Before the charge, the client can report a problem; the charge waits for Support’s review. After the charge, you or the client can open a dispute within 24 hours.
  • You can add information to an open review in the app and should answer Support’s questions. Support may read the messages of the request to decide.
  • Support may decide on a full or partial refund to the client or on payment to you, and may apply the reliability measures above.

9. Client information

  • Use client information you receive through Lawber only to provide the requested service and as your professional rules require, and protect it accordingly.
  • The AI brief is a summary made by an AI model from the client’s information. It can contain mistakes; check the facts with the client.
  • The client’s location and details are shared with you for the request only. Don’t contact clients through Lawber for other purposes.

10. Ending participation

  • You can stop accepting requests at any time. Requests you already accepted must be completed or withdrawn as described above.
  • We may limit, pause or end your access if you no longer meet the requirements, break these Attorney Terms or the Terms of Service, or put clients at risk. Payments for completed work are handled as described in these Attorney Terms.
  • You can delete your account as described in the Privacy Policy; open requests, disputes and payouts are finished first.

11. Changes and contact

  • We may update these Attorney Terms. Each version has a date at the top. If a change is significant, we will ask you to accept the new version before you accept new requests. A request is governed by the version in effect when you accepted it.
